These Terms of Service ("Terms") constitute a binding legal agreement between you ("User," "you," or "your") and GoodSign Limited, a company incorporated under New Zealand law, operating elevatd ("Company," "we," "us," or "our"). These Terms govern your access to and use of elevatd, including our website at https://elevatd.coach and all associated services (collectively, the "Service").

BY ACCESSING OR USING OUR SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE OUR SERVICE.

1. Acceptance and Modifications

1.1 Agreement Formation

Your use of the Service constitutes acceptance of these Terms and our Privacy Policy, which is incorporated herein by reference.

1.2 Amendments

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Continued use of the Service after modifications constitutes acceptance of the revised Terms.

1.3 Eligibility

You must be at least 18 years of age and possess the legal authority to enter into this agreement. By using the Service, you represent and warrant that you meet these requirements.

2. Service Description

2.1 Overview

elevatd sells a one-off, personalised training plan built for a specific race or event that you select. Your plan is generated from the answers you give in our questionnaire — your goals, running history, and available training days — and is delivered to you by email.

2.2 Not Medical Advice

YOUR TRAINING PLAN IS NOT MEDICAL ADVICE. It is a general training guide and does not account for medical conditions we are not aware of. Consult a doctor before starting this or any new training programme, particularly if you have an existing injury, health condition, or have not exercised regularly. You are solely responsible for assessing your own fitness to train and for stopping or adjusting your training if you experience pain, injury, or illness.

2.3 Service Availability

While we strive to maintain continuous service availability, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

2.4 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

2.5 Event Details

Event dates, courses, and other details shown on the Service are provided as a guide and sourced from event organizers. We are not affiliated with, and are not responsible for, the events themselves; always confirm details with the event organizer.

3. User Accounts and Responsibilities

3.1 Account Access

After you buy a plan, we create access to your plan using the email address you provide. You are responsible for keeping access to that email account secure.

3.2 Account Security

You must notify us immediately of any unauthorized use of your account. We are not liable for losses resulting from unauthorized account access due to your failure to maintain account security.

3.3 User Conduct

You agree to use the Service in compliance with all applicable laws and regulations. You shall not engage in any activity that could harm, disable, or impair the Service or interfere with other users' access.

4. Prohibited Uses

You expressly agree not to:

Violate any applicable local, state, national, or international law or regulation
Upload content that infringes upon intellectual property rights or that is unlawful
Transmit or upload malicious software, viruses, or harmful code
Attempt to gain unauthorized access to our systems or other users' accounts
Use the Service to harass, threaten, or harm others
Engage in any form of automated data extraction or abuse of the Service's endpoints
Impersonate any person or entity or misrepresent your affiliation
Circumvent any security measures or access controls

5. Intellectual Property Rights

5.1 Company IP

All content, features, and functionality of the Service, including but not limited to software, text, graphics, logos, training plan content, and trademarks, are owned by GoodSign Limited and protected by copyright, trademark, and other intellectual property laws.

5.2 Your Plan

Your training plan is licensed to you for your own personal use in training for the event you purchased it for. You may not resell, publish, or redistribute it.

5.3 Restrictions

You may not copy, modify, distribute, or create derivative works based on our intellectual property without express written permission.

6. Privacy and Data Protection

6.1 Privacy Policy

Our collection, use, and protection of personal information is governed by our Privacy Policy.

6.2 Data Processing

By using the Service, you consent to our collection and processing of personal data — including any injury or health details you choose to share in the questionnaire — in accordance with our Privacy Policy and applicable data protection laws.

7. Plans, Payment, and Billing

7.1 What You're Buying

Each purchase is a one-off fee for a single personalised training plan for the specific event and date you select at checkout. The price is shown at checkout before you pay. Charges will appear on your statement referencing elevatd or GoodSign Limited.

7.2 No Subscription

Plans are one-off purchases. There is no subscription and nothing renews automatically.

7.3 Payment Processing

Payments are processed by Stripe, our third-party payment processor. You agree to provide accurate billing information and authorize us to charge the price shown at checkout. We never see or store your card number.

7.4 Refund Policy

If you're not happy with your plan, reply to your plan email within 14 days and we'll refund you.

8. Limitation of Liability

8.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 Liability Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOODSIGN LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, OR ANY INJURY OR LOSS ARISING FROM TRAINING OR PHYSICAL ACTIVITY UNDERTAKEN USING YOUR PLAN.

8.3 Damages Cap

Our total liability for any claims arising under these Terms shall not exceed the amount paid by you for the Service during the twelve (12) months immediately preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless GoodSign Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

10. Termination

10.1 Termination by User

You may ask us to close your account at any time by contacting us at support@elevatd.coach.

10.2 Termination by Company

We may suspend or terminate your access to the Service immediately, without notice, for violation of these Terms or for any other reason at our discretion.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account and data, subject to our data retention policies and legal obligations.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of New Zealand, without regard to conflict of law principles.

11.2 Jurisdiction

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

11.3 Alternative Dispute Resolution

Before pursuing formal legal action, parties agree to attempt resolution through good faith negotiations for a period of thirty (30) days.

12. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.

13. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and GoodSign Limited regarding the Service.

15. Additional Provisions

15.1 Assignment

We may assign our rights and obligations under these Terms without your consent. You may not assign your rights without our written consent.

15.2 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

15.3 Electronic Communications

You consent to receive communications from us electronically, and such communications satisfy any legal requirement for written notice.
